1. Acceptance of Terms
By requesting, scheduling, authorizing, or receiving services from Morton’s Mechanical LLC (“Morton’s Mechanical,” “we,” “us,” or “our”), you agree to these Terms of Service. These terms apply to mobile mechanical repairs, maintenance, diagnostics, roadside assistance, inspections, parts installation, and other automotive services we provide.
2. Estimates and Authorization
Any estimate is based on the information and vehicle condition reasonably available at the time it is prepared. An estimate is not a guarantee of the final cost. Additional problems, hidden damage, seized or broken components, incorrect prior repairs, diagnostic findings, parts-price changes, or additional labor may affect the final price.
We will obtain authorization before performing work that materially exceeds the work previously approved. Authorization may be provided in writing, electronically, by text message, by telephone, or through another method that reasonably shows the customer approved the work.
3. Diagnostic Services
Diagnostic fees compensate Morton’s Mechanical for the time, equipment, testing, research, and professional judgment used to identify a problem. A diagnostic fee is due even when the customer chooses not to authorize the recommended repair or when additional testing is required. Because some vehicle problems are intermittent or involve multiple failures, an initial diagnosis may lead to additional diagnostic steps.
4. Parts and Materials
Parts may be new, remanufactured, rebuilt, or otherwise specified on the estimate or invoice. Availability, shipping, and supplier delays are outside our direct control. Parts prices may change before an estimate is accepted or a part is ordered.
If a customer supplies a part, Morton’s Mechanical is not responsible for the quality, fitment, completeness, performance, failure, or warranty of that part. Additional labor caused by an incorrect, defective, incomplete, or incompatible customer-supplied part may be charged separately. Labor involving customer-supplied parts is subject to the Warranty Information page and any limitations stated on the invoice.
5. Mobile Service and Work Area
The customer is responsible for providing a safe, legal, reasonably level, and accessible location where the requested work can be performed. We may decline, stop, or reschedule work when weather, traffic, lighting, property conditions, vehicle location, safety concerns, or other circumstances make the work unsafe or impractical.
Additional travel, roadside, emergency, after-hours, rush, toll, parking, towing, recovery, or similar charges may apply when disclosed or authorized.
6. Customer Responsibilities
The customer must provide accurate information about the vehicle, its symptoms, previous repairs, modifications, known damage, warning lights, and other conditions that may affect diagnosis or repair. The customer must also have the legal authority to authorize work on the vehicle.
Personal property should be removed from areas of the vehicle that must be accessed for service. Morton’s Mechanical is not responsible for loss of or damage to unsecured personal property unless caused by our failure to exercise reasonable care.
7. Payment
Payment is due as stated on the estimate, work order, or invoice. Unless other arrangements are approved in advance, the balance is due when the authorized work is completed. Deposits, special-order parts, diagnostic charges, travel charges, or other agreed charges may be required before work begins or parts are ordered.
Customers are responsible for applicable taxes and authorized fees. Returned payments, chargebacks, collection costs, or other payment-related expenses may be pursued to the extent permitted by law.
Failure to complete payment upon work completion or agreed upon due date will add another $250 each additional day that the payment has not been completed unless an agreement or other communication has been made and agreed upon.
8. Cancellations and Special-Order Parts
Please provide reasonable notice when cancelling or rescheduling an appointment. Deposits or costs associated with special-order, non-returnable, opened, programmed, painted, electrical, or vehicle-specific parts may be non-refundable to the extent permitted by law and as disclosed before purchase.
9. Completion Times
Any completion date or time is an estimate. Delays may occur because of parts availability, weather, additional diagnostic findings, supplier issues, broken or seized components, scheduling, or circumstances outside our reasonable control. Morton’s Mechanical is not responsible for consequential expenses caused solely by a reasonable service delay, except where required by law.
10. Test Drives and Vehicle Operation
By authorizing service, the customer authorizes Morton’s Mechanical to start, move, operate, road-test, scan, lift, or otherwise handle the vehicle when reasonably necessary for diagnosis, repair, verification, or safety. Test drives will be limited to what is reasonably necessary for the service being performed.
11. Pre-Existing Conditions and Modified Vehicles
Morton’s Mechanical is not responsible for pre-existing damage, deterioration, corrosion, worn components, prior improper repairs, aftermarket modifications, or failures unrelated to the work we perform. Modified, high-mileage, heavily corroded, neglected, or previously damaged vehicles may present additional risks that cannot always be identified before work begins.
12. Warranty
Eligible labor performed by Morton’s Mechanical is covered as described on our Warranty Information page and on the applicable invoice. Parts may carry separate manufacturer or supplier warranties. Warranty coverage does not replace the customer’s responsibility to operate and maintain the vehicle properly.
13. Limitation of Responsibility
To the fullest extent permitted by applicable law, Morton’s Mechanical is responsible for direct loss or damage caused by our failure to exercise reasonable care in performing authorized services. We are not responsible for unrelated failures, pre-existing conditions, ordinary wear, misuse, accidents, continued operation after a warning or known problem, or losses caused by circumstances outside our reasonable control.
Nothing in these Terms is intended to waive or limit rights or remedies that cannot legally be waived under applicable law.
14. Refusal or Discontinuation of Service
Morton’s Mechanical may refuse or discontinue service when a requested repair is unsafe, unlawful, outside our capabilities, when the work location is unsafe, when the customer refuses necessary safety procedures, when payment arrangements are not honored, or when abusive, threatening, or fraudulent conduct occurs.
15. Changes to These Terms
We may update these Terms of Service from time to time. The version displayed on this page applies according to the “Last Updated” date shown above, except that an estimate, work order, invoice, or written agreement may contain additional terms specific to a particular job.
